Welcome to www.jobshunk.com. The website “Jobshunk.com”, (hereinafter the Company may be referred to in these Terms and Conditions as “we”, “us” and “our”. The term 'you' refers to the user, visitor or viewer or registered user of the website. This User Agreement describes the terms and conditions, applicable on every person, who avails the service of "JOBSHUNK.COM" under the domain and sub-domains at http://www.Jobshunk.com.

You must read, agree with and accept all of the terms and conditions, contained in this User Agreement, before you may become a user of the Site. Further, entering into the registration process and clicking the "SUBMIT" button, you are agreed to be bound by the Terms and Conditions of the website. If you do not agree to be bound by this terms and conditions as well as the Privacy Policy, you should not use or access the Jobshunk in any manner.

Definitions

The following expressions shall have the following meanings in the Agreement defined below:

  • AGREEMENT: is defined as the completed registration form and its requisite attachment(s) and the terms and conditions herein and is deemed to be have executed
  • COMPANY: is defined as job portal is a private limited company
  • DATE OF ACTIVATION: is defined as the date specified by the Jobshunk in its notice to the User either through email indicating the approval to the User's registration and permission to access the Service.
  • EXPIRY DATE: is defined as the expiry date of the notice of termination of the services.
  • MEMBER: is defined as an individual for any of the Services and the signatory, whose details are contained in the application form, and includes his successors and permitted assignees.
  • JOBSHUNK.COM: is defined as the Internet web site of the Company at www.Jobshunk.com
  • SERVICES: is defined as the services to be provided by the Company to the User at Jobshunk.com including the provision of facilities for the following:
  • A Member who wishes to post a resume to seek employment.
  • A Member who wishes to secure recruitment through Jobshunk.com.
  • A Member who wishes to advertise at Jobshunk.com.
  • Member who wishes to receive advertisements, newsletters and promotional messages on www.Jobshunk.com and through emails.
  • REGISTRATION DATA: is defined as all the information and particulars of the Member requested on initial application and subscription, including but without limiting to the Member's name, email address and telephone number. The words can be used either in the singular or plural sense and those implying one gender shall also include the other.

Member's Obligations

  • The Member is solely responsible for the accuracy of the Registration Data given to the Company in the application for membership in order to use the Service.
  • The Member is responsible for the set-up or configuration of all the necessary equipment required to access the Service.
  • The Member will comply with all notices or instructions given by the Company from time to time in respect of the use of the Service.
  • The Member shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.
  • The Member is solely responsible for the maintenance of confidentiality of the login information.
  • This would include the Member's password and Member Username and all activities and transmission performed by the Member at Jobshunk.
  • The Member will immediately notify the Company of any unauthorized use of the Member's account or any other breach of security known to the Member.
  • The Member will pay promptly the Subscription Fees as required by the Company from time to time.
  • The Member will take all such measures as may be necessary (including without limitation changing his password from time to time) to protect the secrecy.
  • In case you chose to discontinue your association with us, you can unsubscribe / remove your account by completing the delisting procedure using the Remove Account link available in your folder.

17. LAW AND JURISDICTION:

These terms and conditions shall be governed by and construed in accordance with the rules, regulation and laws of India and any disputes relating thereto shall be subject to the only and exclusive jurisdiction of the courts of Gurgaon (Haryana).

BREACHES OF THESE TERMS AND CONDITIONS:

20.1 Without prejudice to our other rights under these Terms and Conditions, if you breach these terms and conditions in any manner, we may take such action as deems appropriate to deal with such breach, by blocking your account, suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or take any legal action against you.

20.2 The failure of Jobshunk to act with respect to a breach by you or others, we do not waive our right to act with respect to previous, subsequent or similar breaches.

TRADEMARKS:

The trademarks, logos and service marks ("Marks") displayed on the Site are the property of Jobshunk and other respective entities. Users are prohibited from using any Marks for any purpose including, but not limited to use as meta tags on other pages or sites on the World Wide Web without the written permission of Jobshunk or such third party which may own the Marks. All information and content including any software programs available on or through the Site ("Content") is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

LAW AND JURISDICTION:

These terms and conditions shall be governed by and construed in accordance with the rules, regulation and laws of India and any disputes relating thereto shall be subject to the only and exclusive jurisdiction of the courts of Gurgaon (Haryana).

ENTIRE AGREEMENT:

These Terms and Conditions as set out herein, constitute the entire user agreement between Way2online Interactive India Private Limited and a user, in relation to use of this website, and supersede all previous agreements in respect of use of this website.

SEVERABILITY:

If a provision of these Terms and Conditions is determined by any court or other competent authority in India or otherwise to be unlawful and/or unenforceable, the other provisions shall continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if any part of it is deleted, that part shall be deemed to be deleted, and the rest of the provision shall continue in effect.
